The law sets out a fixed list of services and products. If yours is not listed, choose the one closest to it.

Can a visitor order, book or create an account with you?

In practice, this is the sharpest dividing line: a site with a checkout, booking function or account environment almost certainly falls under it.

Do you sell to consumers or only to businesses?

The EAA protects consumers. Services to businesses only usually fall outside it — but 'usually' is the key word here.

How many people work for you?

For the micro-exemption, the number of employees counts, and it applies only together with the turnover threshold.

What is your annual turnover?

The second part of the micro-exemption. Both conditions must apply.

In which countries do you supply to consumers?

If you supply in several countries, multiple supervisory authorities may oversee you at the same time. This is not theory: the same checkout button can trigger a case in three countries simultaneously.
